The Process of Selling a Freehold House With BRM Solicitors

Agreement or Contract

We will draft a contract for selling your house to protect your interests.

Enquiries Before Contract

If any queries are raised by the buyers of your property, we will liaise with you so that we can reply to all of the queries.

Mortgage and Finance

Upon the completion of the process of selling your property, we will redeem any mortgages on your behalf and ensure the estate agent’s fees are paid. We will assume that the sale price of the property you are selling will be enough to discharge all mortgages on the property. If this isn’t the case, you must tell us immediately.

Completion Statement and Bill

We will send you our bill and completion statement shortly before completion. Cleared funds for all monies owed in the completion statement are required the day before completion. If we have any money on account left over after selling your house, we will send this to you by cheque.

Selling a Flat

Freehold flats are rare, but much of the same process is involved as when you are selling a house. Due to the nature of flats, the buyer’s solicitors may have extra questions so they can properly advise the buyer.

Our fee assumes that:

This is a standard transaction and that no unforeseen matters arise, including (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction or if this is not a sale by a deceased estate or under a power of attorney.
The transaction is concluded in a timely manner and no unforeseen complication arise.
All parties to the transaction are co-operative and there is no unreasonable delay from third parties providing documentation.
No indemnity policies are required. Additional disbursements may apply if indemnity policies are required.

In the event that any of the circumstances at (1) to (4) above apply then this may result in additional charges details of which will be supplied when we have had sight of your specific documents or as and when any of these issues arise as the transaction progresses.

Disbursements and other costs

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry fees for obtaining up to date copies of the register held by them for your property.

We handle the payment of the disbursements on your behalf to ensure a smoother process. Details of any disbursements applicable will be set out in our fee quote.

Who will deal with your case?

We have four members of the team who may work on your matter, together with support staff who carry out administrative roles. The Head of Department is Stuart Taphouse who will supervise the other team members.

Stages of the matter

The precise stages involved in the sale of a residential property vary according to the circumstances.

However, generally the key stages are set out below:

Take your instructions and give you initial advice
Obtain details of your ownership from the Land Registry
Draft the contract documents and send them to the buyer’s solicitor
Deal with any enquiries raised by the buyer’s solicitor
Contact your mortgage provider and obtain redemption information (if applicable)
Agree completion date (date from which you no longer own the property)
Exchange contracts and notify you that this has happened
Complete sale and pay off your existing mortgage (if applicable)

How long will this process take?

How long it will take for your sale to complete will depend on a number of factors. The average process takes between 8-12 weeks. It can be quicker or slower depending on the parties in the chain. For example, if you are selling to a first time buyer who is purchasing without a mortgage, it could take 6 weeks. However if during the process a defect in your title is discovered that we need to rectify then this can take significantly longer and could add several weeks to the timescale depending upon the nature of the defect. In such, a situation additional charges would apply.
