From today (1 December 2014), new legislation has been introduced as part of the Immigration Act 2014 which requires landlords to carry out “right to rent checks” for all new tenants. This is to determine whether their tenants have a legal right to live in the UK.
In most cases, a simple passport check or biometric residents permit check is enough, but in some cases the landlord may need to perform additional checks with the Home Office.
These requirements are currently only applicable to landlords in the West Midlands, specifically Birmingham, Walsall, Sandwell, Dudley and Wolverhampton. However, this is the first step of a nationwide scheme expected to be phased in over the next year.
